Before using our services, please read these Terms & Conditions (“T&C”) carefully.

These T&C govern your use of our website “https://www.attachmentproject.com” (the “Website” or “Platform”) and your purchase of digital content (including e-books), services provided by us and products (together referred to as “Products” or “Services”).

By using the Website, you agree to these T&C and you acknowledge that these form a legally binding agreement between you and The Attachment Project (“The Attachment Project”).

The Website is operated by MindOnly Pty Ltd, a company with registered address at 7/420 King William Street, Adelaide, SA, 5000, registered in South Australia, Australia with Australian Business Number 67 159 735 387. (hereinafter “MindOnly” or the “Company”).

When these T&C refer to “we”, “us”, “our”, it shall be deemed to be “The Attachment Project”. Whereas references to “you”, “your” or “user” will refer to you as an individual.

These T&C are supplemented in all that is not herein provided for, by the Privacy Policy and the Cookie Policy and which must be expressly accepted when registering with us.

Be aware that the information provided on the Website and/or any of our products do not substitute any professional medical, or psychiatric advice. If you are concerned about your health or mental well-being, you are advised to consult a professional doctor through their appropriate channels.

We would like to specify that:

Our Products are for personal use and are not intended for use in any business, educational, employment or recruitment context;
Our Products do not provide medical advice;
Our Products should not be taken as, or used as a basis for, an exhaustive or accurate judgment or assessment of your personality and psychological health;
You are responsible for any decision you make once you have used or read the content of the Products, are your own responsibility and we are not liable for the consequences of any such decisions.
The Company is not responsible for the mental health of “The Attachment Project” users.

You must be overthe age of 18 years (or above the relevant age of consent in your country) to use the Website and purchase our Products.

These T&C may be updated from time to time. Any significant modifications will be promptly announced to you by e-mail.

About us

The Attachment Project is a project that helps you cultivate attachment security, by supporting you and guiding you on your journey towards better relationships and a happier, more fulfilling life.

To help you, we provide free quizzes where for example, you can find out what your attachment style is. After completing the quiz, and depending on the result, we will suggest you on how to treat that attachment, recommending you the so-called “Attachment Style Workbooks” where you can understand your attachment style better. In addition, we will also suggest different online courses where you can work on some specific aspects.

Registration

You can access many parts of the Website without registering or becoming a member.

If you wish to have access to certain content or Products, you might be required to register on the Website. We may request certain personal data from you when registering on the Website. Please read our Privacy Policy in order to know how your information will be handled.

You might need to create a password when registering. We advise you to keep the password private and not to reveal or share it with anybody. If you suspect that your password is being used by someone else, please contact us at [ . ].

We may ask you to change your password or suspend your account if we have cause to suspect there will likely be a security breach or misuse of the Website involving your account. You might not be able to access some areas of the website until you change your password or activate your account.

Once you have completed the registration process, you will be a registered member of the Website (‘Member‘) and agree to be bound by these T&C. As a Member, you will be granted immediate access to the Products from the time you have completed the registration process until the subscription period expires (the ‘Subscription Period‘).

Quizzes

You will be able to use the Website to take free quizzes.

For the quizzes, you might have to provide certain information, such as your age, gender, and city. After completing the quiz, the results are automatically analysed, and you will receive through the e-mail you provided a certain result depending on which quiz you made, along with a description of the traits of the rest.

The quiz results will be available for a minimum of 7-days or a period set by MindOnly with the PDF document report tailored to your response.

Please be aware, that this information will be handled in accordance with our Privacy Policy.

Purchase of Digital Content and Products

On the Website you may buy digital content and subscription services. They are provided as described there. We reserve the right to change the descriptions and Products offered from time to time.

When you purchase one of our Products, the Product’s copyright and any other intellectual property rights belong to us and/or our authors and/or licensors, as applicable. You agree not to alter or remove any digital rights management data or technology found in our goods, which may be used to discourage or stop unauthorized use of our intellectual property.

Our Services may contain certain sections with content directly linked to external, third-party websites. By interacting with these links, either by clicking or making transactions, you accept and acknowledge the terms and policies of the respective third party which is beyond the responsibility and shall not represent any liability for the Company based on this interaction.

Certain parts of our Services are designed to give you the opportunity to interact with third-party providers and similar entities aiming to deliver specific services. When you submit your contact data in relation to these Services, you acknowledge unambiguously and consent to receiving communication from these third parties, using the contact details you’ve provided. We emphasize that we accept no responsibility or liability concerning any products, work estimates, or services that these third parties may provide. It’s important to note that your consent signifies that you accept these conditions.

Payment

Where the option is given to you, you may make payment of the Subscription by:

Credit or Debit card;
PayPal;
Bank transfer.

All payments made in the course of your use of the Products are made using FastSpring. In using the Website, the Products or when making any payment in relation to your use of the Products, you acknowledge that you have read, understood, and agree to be bound by the FastSpring terms and conditions and privacy policy which are made available to you when making the payment.

You acknowledge and agree that if a request for payment of the Subscription Fee is returned or refused for any reason by your financial institution or is not paid by you for any other reason, you are responsible for any costs, including banking fees and charges, associated with the Subscription Fee.

You agree and acknowledge that the Subscription Fee may vary at any time and that the varied Subscription Fee will come into effect following the conclusion of the existing Subscription Period.

Refunds and cancellation policy

If you are not satisfied with any digital content (e-books or online courses) that you have purchased from the Website or for any other reason, the Company will provide you a refund of the Purchase Amount, provided that certain conditions are met:

Refund is requested within 7 days of purchase,
For online course material, less than 10% of the course material is completed,
For online course material: less than 10% of the course material (including accompanying workbooks and bonuses) are downloaded.
For digital workbooks, the workbook has been downloaded no more than twice.

Where this occurs, the refund will be processed by the Company’s partner for this matter. In case we cease to provide an online course, we will allow it to be downloaded by you within 30 days of notice for your own access with no refund issued.

Subscription

You can access some parts of the Website without registering or subscribing. If you wish to view certain content, or access certain services, you may be required to purchase a Subscription.

In order to access our Services, you will be required to purchase a subscription through the Website and pay the applicable fee. Your password should be kept confidential; you are responsible for any use or misuse of your username and password, and you must promptly notify us of any confidentiality breach or unauthorized use of your username and password, or your Site account.

Once your account is created, you will be able to access the platform and make use of the resources available to the profile you have selected.

You agree and acknowledge that MindOnly shall not be liable before you or any third party for any termination of your access to and use of the Website.

Obligations of the Member/User

As a Member/User, you agree to comply with the following:

Use the Products only for the purposes permitted by law and by these T&C;
You have the sole responsibility for protecting the confidentiality of your password and/or e-mail address
Immediately notify MindOnly of any unauthorised use of your password or e-mail address or any breach of security of which you have become aware;
Access and use of the Website is limited, non-transferable and allows for the sole use of the Website by you for the purposes of MindOnly providing the Services;
Not use the Products or the Website in connection with any commercial endeavours except those that are specifically endorsed or approved by the management of MindOnly;
Not use the Products or Website for any illegal and/or unauthorised use;
Not license, sell, rent, lease, transfer, assign, reproduce, distribute, host, or otherwise commercially exploit the Services or any portion of the Services and will not frame or use framing techniques to enclose any trademark, logo, or Services (including images, text, page layout or form) of the Company;
Not modify, translate, adapt, merge, make derivative works or services of, circumvent, decrypt, disassemble, decompile, reverse compile or reverse engineer any part of our Services or Products;
Not use any manual or automated software, devices, or other processes (including but not limited to spiders, robots, scrapers, crawlers, avatars, data mining tools or the like) to “scrape,” harvest, or download data from the Services;
Not use any data from the Services for the development of any software program (including but not limited to training a machine learning or artificial intelligence (AI) system);
Not access the Services to build a similar or competitive website, application, or service;
Except as expressly authorized by the Company, will not copy, reproduce, distribute, republish, download, display, post or transmit our Product in any form or by any means;
Not remove or destroy any copyright notices or other proprietary markings contained on or in the Services or use the Services in violation of any third party’s intellectual property or other proprietary or legal rights;
Not attempt to gain unauthorized access to other computer systems through the Services;
Not interfere with or attempt to interfere with the proper functioning of the Services or use the Services in any way not expressly permitted herein;
Not attempt to harm our Services or use the Services in a manner that could interfere with any party’s use or enjoyment of the Services, including but not limited to, by violating or attempting to violate any related security features, introducing viruses, worms, or similar harmful code into the Services, or interfering or attempting to interfere with use of the Services by any other user, host, or network, including by means of overloading, “flooding,” “spamming,” “mail bombing,” or “crashing” the Services. Any unauthorized use of the Services immediately terminates the licenses granted by Company herein.

Intellectual property

You acknowledge that the Website may contain certain content (texts, images, videos, graphics, sound, music, animation, and all other information available) which is protected by copyright, patent, trademark, trade secret or other proprietary rights and laws. You may not use our trade name, trademark, or logos in connection with any product or service that is not ours, or in any manner that is likely to cause confusion. Nothing contained on the Website should be construed as granting any license or right to use any trade names, trademarks, service marks, or logos without express prior written consent of the respective owner.

All trade names, trademarks, service marks and logos on the Website not owned by us are the property of their respective owners.

Except as expressly authorized by us, you agree not to modify, copy, frame, scrape, rent, lease, loan, sell, distribute, or create derivative works based on the Website or reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, or otherwise transfer any right or content related to the Website and our products.

You must not use the Platform to develop or commercialize any solution or to compete with the Attachment Project or in any other way which infringes the intellectual property rights of the Company or other copyright protected works made available on the Website of the Attachment Project. Every content provided through our Platform and services are meant exclusively for personal use and shall not be transferred to third parties without prior and express authorization of the Company.

Availability of the Website

MindOnly may suspend, block, stop or cease access to the platform, for all or only one or more users, in the following cases:

When necessary due to technical, strategic, legal, or business constraints;
When necessary to ensure the security of, namely, communication channels, equipment, or information;
When it has strong suspicions of fraudulent or abusive use by you or a third party including the use of robot, spider, crawler, scraper, or other automated means or interface to access the platform or extract other users’ information;
When required by its management, maintenance, repair, modification or update operations of the equipment, systems or any of the Website’s functionalities;
In other circumstances duly justified, including, in particular, in the event of non-compliance by you of your obligations under these Terms & Conditions.

MindOnly has the exclusive right to, at any time, permanently or temporarily, in whole or in part, at any time and at its discretion, shut down the Website or any of its functionalities without prior notice.

MindOnly will put its best efforts to provide you the best possible services. However, it does not guarantee that MindOnly will be fault free. If a fault does occur, please report it to the Attachment Project’s Customer Services, at team@attachmentproject.com and we will attempt to correct the fault promptly.

Warranties

The use of the platform is at your sole risk. Except as expressly set out in these Terms, the WEBSITE is provided on an “as is” and “as available” basis and to the maximum extent permitted by the applicable law, exclusive of any warranties and representations, whether express, implied or statutory, including without limitation, warranties of merchantability, fitness for a particular purpose, non-infringement or warranty of uninterrupted services, all of which are hereby expressly disclaimed.

MindOnly makes no warranty that (i) the platform or the content provided will meet your requirements, (ii) the platform will be uninterrupted, timely, secure, or error-free, (iii) any results, advice, recommendation or information that may be obtained from the use of the platform will be accurate, precise, complete, or free from errors or reliable, or (iv) the quality of the platform, functionalities, information, or other material obtained by you through the platform will meet your expectations.

WE MAKE NO REPRESENTATION OR WARRANTY THAT THE WEBSITE (OR ANY PART THEREOF) WILL BE ACCURATE, COMPLETE OR ERROR-FREE, NOR THAT ANY PARTICULAR SOFTWARE OR HARDWARE, WILL BE COMPATIBLE WITH THE WebSITE, AND YOU HEREBY AGREE THAT IT IS YOUR SOLE RESPONSIBILITY TO (A) OBTAIN AND PAY FOR ANY SOFTWARE, HARDWARE AND SERVICES (INCLUDING INTERNET CONNECTIVITY) NEEDED TO ACCESS AND USE THE WebSITE, AND (B) ENSURE THAT ANY SOFTWARE, HARDWARE AND SERVICES THAT YOU USE WILL FUNCTION CORRECTLY WITH THE WebSITE. YOU AGREE THAT YOU MUST EVALUATE, AND THAT YOU BEAR ALL RISKS ASSOCIATED WITH THE USE OF THE SITE, INCLUDING ANY RELIANCE ON THE ACCURACY, COMPLETENESS OR USEFULNESS OF ANY INFORMATION OR MATERIALS MADE AVAILABLE THROUGH OR IN CONNECTION WITH THE SITE.

Liability

The Company is not responsible for the mental health of “The Attachment Project” users. Our Platform provides for educational and informational use only and is not intended to be used by the customer for any diagnostic purpose and is not a substitute for professional medical advice. You should always seek the advice of your physician or other healthcare providers with any questions you may have regarding diagnosis, cure, treatment, mitigation, or prevention of any disease or other medical condition or impairment or the status of your health.

You acknowledge and agree that the Company, its affiliates, employees, agents, contributors, and licensors are not responsible for any direct, indirect, incidental, special consequential or exemplary damages that you may suffer, regardless of how those damages were caused or the basis for liability. The Company is not responsible for any loss of profit (whether incurred directly or indirectly), any of reputation or any other intangible loss.

Security

We will put our best efforts into ensuring that the Website does not have any type of virus or other related elements which may be dangerous to your computer or mobile device. However, since we cannot fully control the information flow on the Internet, it cannot guarantee that it does not contain any type of virus or other elements that may damage your computer or mobile device.

In order to ensure security of the Website, we may, at any time and without prior notice, take the necessary measures to ensure the integrity, security, continuity, or quality of the Website, including restrictions or limitations of access.

Governing law and jurisdiction

These Terms & Conditions shall be exclusively governed by and construed in accordance with the laws of South Australia, Australia. Any disputes arising from these Terms & Conditions shall be settled by the courts of Adelaide, South Australia, with express waiver of any other.

General provisions

If there is a breach to these T&C, we may take such action as we deem appropriate to deal with the breach such as suspending your access to the Website, prohibiting you from accessing the Website, including but not limited to suspending your access, prohibiting you from accessing the Website.

If any section, term, or provision of these T&C is held invalid or unenforceable by a competent court of the country you live in, such invalidity shall not affect the validity or operation of any other section, term or provision, and such invalid section, term or provision shall be deemed to be severed from these T&C.

These Terms & Conditions constitute the entire agreement between you and the Attachment Project and govern the Services and use of the Website.

You may also be subject to additional terms and conditions which may be applicable when using third party services, software, or content.
